Easy City Storage Terms and Conditions
Last Updated: [2024-05-10]
1. Introduction
These Terms and Conditions ("Terms") govern the use of storage services provided by Easy City Storage ("Provider"). By using our services, you ("Customer") agree to these Terms.
2. Service Request and Responsibility
The Customer has requested storage services from Easy City Storage, located at 60 Airedale Street, Auckland CBD. Easy City Storage is not responsible for providing any additional goods or services beyond those specified in the storage agreement.
3. Minimum Hire Term and Payment
The minimum hire term is one calendar month, with payment due monthly in advance. Customers are advised to notify us for renewal or set up automatic bank payments to ensure uninterrupted service for continual storage. Price is per month +GST.
4. Service Termination
The service may be terminated by either party after the initial month, with an email notice period of two weeks (Email to: service@easycitystorage.co.nz). If the Customer provides a termination notice less than two weeks before the end of the current rental period, the Customer will be responsible for an additional month of storage fees. For example, if the rental period ends on June 30th and the Customer provides notice of termination on June 26th, the Customer is obligated to pay for the following month’s storage fees due to the short notice. Moreover, the Customer remains liable for hire charges until the storage space is properly vacated, as specified in Clause 5 below.
5. Use of Service
The Customer may use the service solely for storage purposes and must not store any dangerous, flammable, perishable items, or any goods likely to cause health hazards, attract vermin, or be offensive. Additionally, the storage of drugs is strictly prohibited. The Customer shall indemnify Easy City Storage for any loss or damage (including third-party claims) resulting from any breach of this Agreement by the Customer.
6. Liability for Service Charges Post-Termination
Notwithstanding the termination of the legal storage service, the Customer remains liable for the service charges under this agreement until all stored items have been removed.
7. Lien and Disposal of Stored Items
If the Customer is in arrears of the hire charge for one calendar month, Easy City Storage shall have a lien over all stored items. Upon providing two weeks' notice to the Customer, Easy City Storage may retain the stored items’ contents to cover all outstanding payments. Alternatively, Easy City Storage may sell the contents by auction, destroy them, or dispose of them in any manner, without any liability to the Customer for any resulting loss. Easy City Storage is not obligated to ascertain the value of any destroyed items.
8. Charges and Payment
The storage fee is payable monthly in advance. If you need to buy the box from us, each box (50*50*38cm) costs $5 (Delivery fee inclusive). Additional fees may apply for extra deliveries, special handling, or other services the Company provides.
9. Responsibility for Stored Goods
Easy City Storage accepts no responsibility for any loss or damage to goods stored in the unit, regardless of the cause, including any fault on the part of Easy City Storage. Customers are strongly advised to arrange insurance for their goods, covering theft, fire, and water damage.
10. Access and Delivery
The Customer does not have direct access to the Storage Space. The Company will deliver the stored items to the Customer upon request with a scheduled delivery date.
Customers can access their stored items at 60 Airedale Street by calling us upon arrival. Our staff will retrieve your parcels from our secure, 24/7 monitored storage floors and bring them to you. Access is free during office hours; fees may apply for access outside of office hours.
11. Notice
Notices will typically be provided in writing and sent via email to service@easycitystorage.co.nz. If the Storer cannot be contacted, notice is deemed to have been given if Easy City Storage makes reasonable attempts to send the notice to the specified email address or to the Alternate Contact Persons identified in this agreement.
12. Hire Charge Increases and Agreement Modifications
Easy City Storage may increase the hire charge by providing the Customer with one month's notice. If the Customer does not agree to the increase, they may terminate this hire agreement. The Company reserves the right to modify this Agreement with 30 days’ notice to the Customer. Continued use of the storage services after such changes implies acceptance of the new terms.
13. Authorized Access
Only persons recorded as being authorized to access the stored items in the agreement are permitted to do so. The obligation of Easy City Storage is to ensure that access is granted solely to these authorized individuals. The Customer is responsible for providing and updating the list of authorized persons. Easy City Storage is not liable for any loss or damage arising from unauthorized access if it occurs due to the Customer's failure to update or accurately maintain this list. Additionally, the Customer must ensure that all authorized persons comply with the terms and conditions of the storage agreement.
14. Governing Law
This Agreement is governed by the laws of New Zealand.
15. Customer Acknowledgment
I, the Customer, have read, understood, and agree to the terms and conditions of this Service Agreement.
